Abstract

This case review critically examines the impact of the Supreme Court decision as to the legality of the arbitral agreement after the Kazakhstan Supreme Court had declared the agreement to be invalid. It also explores the implication of the verdict and how the supreme court arrived at such a determination. This work further scrutinises the impact of the anti-suit injunction and the reasons given by the Supreme Court to intervene in a matter relating to court proceedings in a foreign jurisdiction.
